Catoniāna regŭla

Catoniāna regŭla (lat.), eine nach Cato Licinianus benannte Bestimmung, derzufolge ein Vermächtnis (legatum), das wegen seines Inhalts nicht gültig gewesen sein würde, wenn der Erblasser sofort nach dessen Errichtung gestorben wäre, unwirksam bleibt, auch wenn der Grund der Ungültigkeit vor dem Tode des Erblassers weggefallen ist. Das Bürgerliche Gesetzbuch steht auf dem entgegengesetzten Standpunkt, indem jetzt nur ein zur Zeit des Erbfalls noch vorliegender Grund der Ungültigkeit die Unwirksamkeit des Vermächtnisses bewirkt (§ 2171).
