Binding

Binding, Karl, Kriminalist, geb. 4. Juni 1841 in Frankfurt a. M., studierte in Göttingen und Heidelberg Geschichte und Rechtswissenschaft, wurde 1864 Privatdozent in Heidelberg, dann ordentlicher Professor der Rechte in Basel und Freiburg, 1872 an der neubegründeten Universität zu Straßburg und 1873 in Leipzig. Von seinem historischen Werk: »Das burgundisch-romanische Königreich« ist bisher nur der erste Band (Leipz. 1868), mit einer wertvollen Beilage Wackernagels über die Sprache und Sprachdenkmäler der Burgunden, erschienen. Unter seinen juristischen Schriften ist vor allem hervorzüheben die bedeutende Monographie »Die Normen und ihre Übertretung. Eine Untersuchung über die rechtmäßige Handlung und die Arten des Deliktes« (Leipz. 1872–77, 2 Bde.; Bd. 1 in 2. Aufl., das. 1890), in der B. eine Revision der allgemeinen Lehren des Strafrechts unternahm. Eine systematische Darstellung des heutigen Strafrechts hat B. in seinem »Handbuch des Strafrechts« begonnen (Bd. 1, Leipz. 1885), das einen Teil des von ihm wit andern unternommenen »Systematischen Handbuchs der deutschen Rechtswissenschaft« bildet. Unter Bindings sonstigen Schriften sind noch zu nennen: »Kritik des Entwurfs zum Strafgesetzbuch für den Norddeutschen Bund« (Leipz. 1870); »Die drei Grundfragen der Organisation des Strafgerichts« (das. 1876); »Das Problem der Strafe in der heutigen Wissenschaft« (Wien 1877); »Grundriß des gemeinen deutschen Strafrechts«, 1. Teil (6. Aufl., Leipz. 1902), 2. Teil als »Lehrbuch des gemeinen deutschen Strafrechts« (das. 1893–1901, 2 Bde.; Bd. 1 in 2. Aufl. 1902); »Grundriß des gemeinen deutschen Strafprozeßrechts« (4. Aufl., das. 1900); »Die Gründung des Norddeutschen Bundes« (das. 1888); »Die Ehre und ihre Verletzbarkeit« (Rektoratsrede, das. 1892); »Der Versuch der Reichsgründung durch die Paulskirche in den Jahren 1848 und 1849« (Akademische Rede, das. 1892); »Die rechtliche Stellung des Kaisers im heutigen Deutschen Reiche« (Dresd. 1898); »Das Thronfolgerecht der Kognaten im Großherzogtum Luxemburg« (Leipz. 1900). Auch gab er »Deutsche Staatsgrundgesetze in diplomatisch treuem Abdruck« heraus (Leipz. 1893 ff.).
