Jus gentĭum

Jus gentĭum (lat., »Recht der Völker«, nicht zu verwechseln mit dem heutigen »Völkerrecht«, jus inter gentes), in der römischen Rechtssprache das in Rom neben dem jus civile (s. d.) durch Gewohnheit und Jurisprudenz geltend gewordene Recht, das die Bestimmung hatte, dem römischen Richter zur Beurteilung der Verhältnisse zu dienen, die sich aus dem Verkehr der Römer mit Fremden und der Fremden unter sich ergaben, da hierauf das jus civile unanwendbar war. Der Name erklärt sich daraus, daß die Römer die Wahrnehmung machten, es würden im wesentlichen die Sätze ihres J. bei allen Kulturvölkern anerkannt (jus quod peraeque apud omnes gentes custoditur).
