Indictment

Indictment (engl., spr. indāītment), in England diejenige Art der Kriminalanklage, durch welche die Strafsache von der großen (Anklage-) Jury an die kleine (Urteils-) Jury gebracht wird; daher nennt man die Schwurgerichtssachen auch indictable offenses Wer eine Strafsache an die Gerichte bringen will (pro-secutor), reicht eine Anklageschrift (bill of i.) unter Angabe der Beweismittel bei der großen Jury ein. Die letztere prüft die Beweise. Erachtet sie auf Grund dieser Prüfung die Anklage für grundlos, so wird auf die Rückseite der Anklageschrift geschrieben: »Unbegründete Anklage« (not a true bill). Damit ist der Beschuldigte losgesprochen (discharged). Kommt dagegen die große Jury zu der Überzeugung, daß der Beschuldigte das Verbrechen begangen habe, so wird auf die Rückseite der Bill geschrieben: »Begründete Klage« (a true bill). Der Beschuldigte ist von diesem Moment an im Anklagezustand (indicted). Die biill of i. wird nun als i. an die kleine Jury zur Aburteilung hinübergegeben.
