Exasperation

Exasperation (lat.), Erbitterung, Verschärfung; exasperieren, erbittern, ein Übel verschärfen. Exasperationsprinzip oder Asperationsprinzip, im Strafrecht Grundsatz, beim Zusammentreffen mehrerer Straftaten nicht etwa die für jede einzelne Straftat erkannten Strafen zusammenzuzählen und als Gesamtstrafe auszusprechen, sondern die verwirkte höchste Strafe als Einsatzstrafe festzuhalten und die übrigen Einzelstrafen verhältnismäßig zu kürzen und zur Einsatzstrafe hinzuzurechnen, so daß die Gesamtstrafe geringer ist als die Summe sämtlicher Einzelstrafen. Hierbei darf die Gesamtstrafe die Höhe von 15 Jahren Zuchthaus, 10 Jahren Gefängnis und 15 Jahren Festung nicht überschreiten (§ 74 des Deutschen Reichsstrafgesetzbuches).
